1. Acceptance of terms

By accessing and using askng.it's services, you accept and agree to be bound by these terms of service and our privacy policy. These terms apply to all visitors, users, and others who access or use the service.

If you are using the service on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.

2. Use of service

You agree to use our service only for lawful purposes and in accordance with these terms. You are responsible for:

• All activities that occur under your account
• Ensuring your use complies with all applicable laws and regulations
• Not using the service for any fraudulent or illegal purpose

3. Subscription and payment

Subscription fees are billed in advance on a monthly or annual basis, depending on your selected plan. By subscribing, you authorise us to:

• Charge the payment method on file for the subscription period
• Automatically renew your subscription unless you cancel
• Update pricing with 30 days' advance notice
• Suspend service for non-payment after reasonable notice

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. No refunds are provided for partial subscription periods.

4. Intellectual property

The service and its original content, features, and functionality are owned by askng.it and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of all content you submit to the service. By submitting content, you grant us a licence to use, store, and process that content solely to provide the service.

5. Data processing and privacy

As a hospitality communication platform, askng.it processes guest data on behalf of our customers. Our customers remain the data controllers, and askng.it acts as a data processor in accordance with:

• The General Data Protection Regulation (GDPR)
• The California Consumer Privacy Act (CCPA)
• Other applicable data protection laws

6. Service level and availability

We strive to maintain 99.9% uptime for our service. However, we do not guarantee uninterrupted access and may need to suspend the service for:

• Scheduled maintenance (with advance notice)
• Emergency security updates
• Technical issues beyond our control
• Compliance with legal requirements

7. Termination

We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including:

• Breach of these terms of service
• Fraudulent or illegal activity
• Non-payment of fees
• Violation of applicable laws or regulations

Upon termination, your right to use the service will immediately cease. We will provide you with a reasonable opportunity to export your data within 30 days of termination.

8. Limitation of liability

To the maximum extent permitted by law, askng.it shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, resulting from your use or inability to use the service.

9. Indemnification

You agree to indemnify and hold askng.it harmless from any claims, damages, losses, liabilities, and expenses arising from your use of the service or violation of these terms.

10. Changes to terms

We reserve the right to modify these terms at any time. We will notify you of any material changes via email or through the service. Continued use of the service after changes constitutes acceptance of the modified terms.

11. Governing law

These terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Amsterdam, Netherlands.
